American National Bank of Texas Certified To ERISA 3(16) Administrator Role

Dallas, TX, May 13, 2014 – The Centre for Fiduciary Excellence (CEFEX), announced today that it has certified the trust department of American National Bank of Texas (ANBTX), as adhering to a global standard of excellence for Investment Stewards. ANBTX is the first entity in the U.S. to be independently certified in the ERISA 3(16) Plan Administrator role.
The CEFEX standard of excellence for Investment Stewards is based on 21 fiduciary practices intended for persons who have the legal responsibility for overseeing someone else’s money, including trustees and investment committee members. The standard also applies to the role of the Employee Retirement Income Security Act (ERISA) Section 3(16) fiduciary who is responsible for managing the day to day operation of a retirement plan.
Certification demonstrates fiduciary skills, knowledge and investment awareness as well as a fundamental understanding of the law to effectively delegate and share responsibility with other fiduciaries. It also helps uncover investment and/or procedural risk, and establishes a framework for applying the skill, knowledge, diligence and good judgment of a professional organization in this role.
ANBTX has been certified for its provision of investment steward services and fiduciary services to defined contribution plan sponsors serving in a Named Fiduciary role as the ERISA 3(16) plan administrator and/or an ERISA 403 trustee with discretionary investment authority and responsibility for plan governance.
The fiduciary practices are based on the publication: Prudent Practices for Investment Stewards published by fi360, Inc. and edited by the American Institute of Certified Public Accountants (AICPA). The Practices are substantiated by legislation, case law and regulatory opinion letters from the Investment Advisors Act of 1940, Employee Retirement Income Security Act (ERISA), Uniform Prudent Investor Act (UPIA), Uniform Prudent Management of Institutional Funds Act (UPMIFA) and the Uniform Management of Public Employee Retirement Systems Act (UMPERSA) in the U.S.A summary of the fiduciary practices can be viewed by clicking on ANBTX’s on-line CEFEX certificate.
